Terms & Conditions Effective Date: March 30, 2025
Welcome to Tracie’s Getaways, LLC. You agree to the following Terms & Conditions by booking travel services with me. Please read carefully, as these terms outline the responsibilities and limitations of our services.
1. Scope of Services
I act as an independent travel advisor, facilitating travel arrangements, including but not limited to flights, hotels, cruises, transportation, tours, and activities. I do not own or operate any of these services, and all bookings are subject to the terms and conditions of the respective travel suppliers.
2. Bookings & Payments
A deposit or full payment may be required at the time of booking, depending on the supplier’s terms.
Your booking is not confirmed until the required payment is received and you receive written confirmation from us.
Final payment deadlines will be communicated, and failure to pay on time may result in cancellation with penalties.
Prices are subject to change until payment is made.
Any unauthorized chargeback or payment dispute may result in legal action and additional fees.
3. Cancellations, Changes & Refunds
Cancellation policies vary by supplier and will be communicated at the time of booking.
Any cancellation fees imposed by the supplier are the responsibility of the client.
Travel insurance is strongly recommended to protect against unforeseen cancellations or emergencies.
Changes to confirmed bookings may incur fees, and availability is not guaranteed.
Refunds, if applicable, will be subject to the supplier’s terms and may take several weeks to process.
4. Liability Disclaimer
I act solely as an agent between you and travel suppliers and am not liable for any loss, injury, delay, or damage caused by third parties.
I am not responsible for disruptions, cancellations, or force majeure events (e.g., weather, natural disasters, pandemics, government restrictions, or strikes).
Any issues arising during travel should be addressed directly with the service provider.
Under no circumstances shall I be liable for any indirect, incidental, special, or consequential damages.
5. Client Responsibilities
You are responsible for ensuring your travel documents (passports, visas, vaccinations) are valid for your trip.
You must review all booking details upon confirmation and notify me of any discrepancies immediately.
You agree to comply with airline, hotel, and tour policies, including check-in times and baggage allowances.
You agree to indemnify and hold harmless Tracie’s Getaways, LLC from any claims, damages, losses, or expenses arising from your travel or failure to comply with these Terms & Conditions.
6. Travel Insurance
Travel insurance is highly recommended to cover cancellations, medical emergencies, lost luggage, and other unforeseen circumstances.
I am not responsible for any losses incurred due to a client’s decision to decline insurance coverage.
7. Force Majeure
I am not liable for failure or delay in providing services due to circumstances beyond my control, including but not limited to natural disasters, pandemics, acts of terrorism, or government restrictions.
8. Dispute Resolution & Governing Law
Any disputes shall first be attempted to be resolved through informal negotiation.
If a resolution cannot be reached, disputes will be settled through binding arbitration in the United States.
These Terms & Conditions shall be governed by and interpreted in accordance with the laws in the state of Missouri.
9. Modification of Terms
I reserve the right to update these Terms & Conditions anytime without prior notice. The latest version will always be available on my website or provided upon request.
